A commission agent sold goods which had been placed in his hands for sale, and thereafter the principal went with him to the buyer, to whom the agent for the first time disclosed his principal, and to whom he desired that a bill should be granted for the price, which was accordingly done by the buyer; but before it was delivered, the agent interposed, and claimed it for himself. The principal having become bankrupt, held in a question with the trustee in the sequestration, that although the agent alleged that the principal was indebted to him in the price of two parcels of goods, one of which had been purchased previous to the sale on account of which the bill was granted, he had no right of retention or compensation, and the trustee preferred. The master of a ship gave a draft on the owners, payable to their agents at a foreign port, for the amount of necessary disbursements. The agents indorsed the bill for value. Acceptance was refused by the owners, on the ground that they had claims against their agents exceeding the amount drawn for. In a question with the indorsee, held that the owners were entitled to set off against the claim for disbursements their claims against the disbursers, aud that the shipmaster had no power to bind his owners in a bill debt. Issues adjusted to try whether the advances had been made, and counter issues as to whether the disbursers were liable to the owners in the debts averred.
